Data Fiduciary

CAPGENX Private Limited (CIN U62099KA2026PTC214139) is the Data Fiduciary for Lexqo. That means we decide why personal data is used on this product.

Effective date of this version: 20 October 2026. It applies to users of the India product at lexqo.ai. When we change this notice in a way that matters, we ask you to accept the new version in the app before you continue.

Why we may use your data

• To provide the service you asked for — account, lessons, Study Studio, payments, support.
• To keep the service safe — OTP, fraud checks, content moderation, security logs.
• Because you chose it — optional analytics or marketing cookies, camera, or microphone.
• Where Indian law requires it — tax invoices, certain cyber-incident logs, lawful requests.

Account and profile

Name, email, school/college/professional stage, grade or programme, language and currency preferences, and profile photo (if you add one). We do not ask learners for a date of birth, phone number or home address. Faculty and parent accounts also give a phone number.

Learning and AI use

Lesson activity, Study Studio prompts and generated lessons, uploads to Study Desk, quizzes, support tickets, and device information used to keep your session secure.

Who in Lexqo can see your learning

If you join a faculty member's class, that faculty member can see your enrolment, progress, assignments and reports for their courses. If a parent or guardian links your account, they can see your learning activity and progress. Nobody else on Lexqo sees your data.

Optional camera, microphone, and payments

Camera and microphone stay off until you turn them on. If enabled, we may process audio for that session and attention signals during a lesson. Payments are processed by Razorpay; we store invoice and GST records, not full card numbers.

Purposes

• Create and secure your account, including OTP login
• Deliver tutoring, Study Studio, exam prep, and faculty tools
• Process subscriptions, credits, and GST invoices
• Moderate unsafe content and keep the platform reliable
• Respond to support and grievance tickets
• Meet Indian law, including DPDP, IT Act, tax, and CERT-In log duties

Retention

We keep an account while it is active. After a valid deletion request we aim to complete erasure in 7-30 days. We still keep what the law requires, including GST invoices for the tax period and security or access logs. Our operating target for those logs is at least 180 days (the CERT-In direction for certain incidents). That target is a practice we are implementing; it is not a completed CERT-In audit certificate.

Voice is processed for the session. Camera attention data, if you enable the camera, is kept only as long as needed for that lesson feature.

Who else sees data

We share personal data with vendors only to run Lexqo:

• Amazon Web Services — hosting, database, sign-in (Amazon Cognito), and AI models through Amazon Bedrock (including Anthropic Claude, OpenAI and Cohere models)
• Cloudflare — website delivery and security, and file storage for lesson media and uploads
• Google — Gemini models for lessons, voice and pictures (Google AI Studio), and push notifications (Firebase Cloud Messaging)
• OpenAI — safety checks (moderation) of uploads and prompts
• Sarvam AI — Indian-language speech, when that voice is used
• A GPU hosting provider — renders the talking-avatar video from lesson narration
• Razorpay — payments (card data stays with Razorpay)
• SendGrid — email OTP and transactional mail
• Sumsub — faculty identity checks only
• Google Analytics, Microsoft Clarity and Meta Pixel — only if you opt in on the cookie banner

Where data is stored: our servers and database run in Amazon Web Services' Frankfurt region (Germany), and files are stored with Cloudflare. AI providers may process a request in the United States or other countries. We remain the Data Fiduciary. Using Study Studio, Guided Learning or similar AI features means your prompt and related content are sent to those processors to produce the answer.

We do not sell personal data

We do not sell personal information for money. We may disclose data if Indian law requires it, or to protect users and the platform from abuse or crime.

Age rules on Lexqo

Under the DPDP Act, a child is a person under 18. Users under 18 must have explicit consent from a parent or guardian before using Lexqo.

What we do today:

• When you create an account, you confirm that you are 18 or older, or that your parent or guardian has agreed to your use of Lexqo and to this notice.
• We do not ask for a date of birth, and we do not yet verify that consent ourselves (for example with a parent OTP). A parent or guardian who did not agree can ask us to delete the account at any time.
• Camera and microphone stay off until the user turns them on.
• Optional marketing cookies should not be enabled on a child’s device.

For the current B2C product, CAPGENX Private Limited remains the Data Fiduciary. A school is not treated as a separate fiduciary unless a written institution contract says otherwise.

Your rights

You may ask us to:

• Show you what personal data we hold (access)
• Correct it if it is wrong
• Erase it, except where we must keep it by law
• Withdraw consent for optional cookies, camera, or microphone — the core account and lessons still need necessary data
• Export a copy — download it as a file from Privacy settings. If the download does not work, contact support and we aim to send it within 7-15 days.
• Delete the account yourself in the app (profile menu → Account & Privacy → Delete this account), or contact support at capgenx.com/contact. Deletion is permanent. We aim to finish erasing it within 7-30 days, including backups.

Complaints

Write to the Grievance Officer on /grievance. You may also approach the Data Protection Board of India after using our process.
